DandyRX Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the DandyRX website, mobile services, communications, products, and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Services.

1. Company Information
   The Services are operated by DandyRX, LLC (“DandyRX,” “Company,” “we,” “our,” or “us”).

2. Eligibility
   You must be at least eighteen (18) years of age and legally capable of entering into binding agreements to use the Services.
   By using the Services, you represent and warrant that:
   • You are at least 18 years old;
   • Information you provide is truthful, accurate, and complete;
   • You are legally authorized to receive healthcare services where you reside;
   • You will not use the Services for unlawful purposes.

3. DandyRX Is Not a Medical Provider
   DandyRX is a technology platform that facilitates access to independent licensed healthcare providers and licensed pharmacies.
   DandyRX does not practice medicine, pharmacy, nursing, or any other licensed healthcare profession.
   Healthcare services are provided solely by independent licensed healthcare professionals exercising their own independent medical judgment.
   Nothing on the Services constitutes medical advice, diagnosis, or treatment.

4. No Prescription Guarantee
   Payment for a consultation, evaluation, membership, subscription, or service does not guarantee that a prescription will be issued, renewed, modified, or continued.
   Healthcare providers determine eligibility for treatment based solely upon their independent medical judgment, applicable law, and clinical standards.
   Providers may determine that treatment is not appropriate for you.
   No refunds will be issued solely because a prescription was not issued when a provider has completed their review.

5. Pharmacy Services
   Prescriptions, when issued, are fulfilled by licensed partner pharmacies.
   DandyRX does not manufacture, dispense, compound, package, or ship medications.
   Pharmacy partners may vary based upon patient location, provider decisions, medication availability, and applicable laws.

6. Telehealth Services
   Telehealth services may include health questionnaires, secure messaging, asynchronous consultations, video consultations, prescription management, follow-up care, and other healthcare-related services.
   By using the Services, you consent to receive healthcare services through telehealth technologies where permitted by law.
   You acknowledge that telehealth services may involve limitations, including technological failures, interruptions, and the inability to perform certain physical examinations.

7. Emergency Situations
   THE SERVICES ARE NOT INTENDED FOR EMERGENCY MEDICAL CARE.
   If you believe you are experiencing a medical emergency, call 911 immediately or seek emergency medical treatment.
   Do not use the Services for urgent or emergency conditions.

8. Products and Treatments
   Available treatments may include, but are not limited to:
   • Erectile Dysfunction
   • Hair Loss
   • Weight Management
   • Peptide Therapies
   • Other treatments made available from time to time
   Treatment availability varies by state, provider licensure, pharmacy capabilities, and applicable law.
   Certain products or services may not be available in all jurisdictions.

9. Subscription Services and Auto-Renewal
   Certain Services may be offered on a recurring subscription basis.
   By enrolling in a subscription, you authorize DandyRX and its payment processors to automatically charge your payment method for recurring fees and applicable taxes until cancelled.
   Subscription fees will automatically renew unless cancelled before your next scheduled billing date.
   You may cancel your subscription at any time before the next billing date through your account or by contacting support@dandyrx.com.
   Cancellation will stop future recurring charges but will not entitle you to refunds for services already rendered, consultations already performed, medications already dispensed, or charges previously incurred.

10. Refund Policy
    Consultation fees become non-refundable once a healthcare provider has begun reviewing your information.
    Prescription medications generally cannot be returned due to safety and regulatory requirements.
    Damaged, defective, or incorrectly fulfilled orders may be eligible for replacement or resolution at DandyRX’s discretion and subject to pharmacy policies.
    Billing errors will be promptly investigated and corrected when verified.

11. Payment Authorization
    You authorize DandyRX and its payment processors to charge your selected payment method for purchases, subscriptions, consultations, shipping fees, taxes, and other applicable charges.
    You agree to maintain accurate payment information.
    Failure to maintain valid payment information may result in suspension or termination of Services.

12. Chargeback Resolution
    If you believe a billing error has occurred, you agree to contact DandyRX before initiating a chargeback, payment dispute, or claim with your financial institution.
    DandyRX will make reasonable efforts to investigate and resolve billing concerns promptly.
    Nothing in this section limits your legal rights under applicable law.

13. Electronic Communications
    You consent to receive communications electronically, including account notices, disclosures, treatment updates, billing communications, and customer support responses.
    Electronic communications satisfy any legal requirement that such communications be in writing.

14. SMS Communications
    If you provide a mobile phone number, you consent to receive transactional and healthcare-related communications.
    Message and data rates may apply.
    Consent to receive SMS communications is not a condition of purchase.
    You may opt out according to instructions provided in the message.

15. Privacy and HIPAA
    Use of the Services is subject to the DandyRX Privacy Policy and Notice of Privacy Practices.
    Protected Health Information is handled in accordance with applicable federal and state laws, including HIPAA where applicable.

16. User Responsibilities
    You agree not to:
    • Provide false or misleading information;
    • Impersonate another person;
    • Share prescription medications;
    • Attempt unauthorized access to systems;
    • Use the Services for unlawful purposes;
    • Interfere with operation of the Services.

17. Intellectual Property
    All content, trademarks, logos, software, graphics, text, and materials available through the Services are owned by DandyRX, LLC or its licensors.
    No rights are granted except as expressly stated in these Terms.

18. Disclaimer of Warranties
    THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
    TO THE MAXIMUM EXTENT PERMITTED BY LAW, DANDYRX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

19. Limitation of Liability
    TO THE MAXIMUM EXTENT PERMITTED BY LAW, DANDYRX SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
    DANDYRX’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT PAID BY YOU TO DANDYRX DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

20. Mandatory Arbitration and Class Action Waiver
    Any dispute arising out of or relating to these Terms, the Services, products, consultations, subscriptions, or transactions shall be resolved exclusively through binding individual arbitration.
    Arbitration shall be administered by the American Arbitration Association under its applicable consumer arbitration rules.
    You and DandyRX waive any right to a jury trial.
    You and DandyRX further agree that disputes may only be brought on an individual basis and not as part of any class action, collective action, mass arbitration, or representative proceeding.

21. Governing Law
    These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming without regard to conflict of law principles.

22. Changes to Terms
    DandyRX may modify these Terms at any time.
    Updated Terms will be posted on the website with a revised effective date.
    Continued use of the Services after updates become effective constitutes acceptance of the revised Terms.
