DandyRX Telehealth Informed Consent

This Telehealth Informed Consent (“Consent”) applies to healthcare services provided through the DandyRX platform by independent licensed healthcare providers.
By using DandyRX and receiving telehealth services, you acknowledge that you have read, understood, and agreed to this Consent.

1. Understanding Telehealth Services
   Telehealth involves the delivery of healthcare services using electronic communications, information technology, secure messaging, video conferencing, telephone communications, online questionnaires, and other digital technologies.
   Telehealth services may include:
   • Medical evaluations;
   • Health assessments;
   • Treatment recommendations;
   • Prescription management;
   • Follow-up care;
   • Patient education;
   • Secure communications with healthcare providers.
   Healthcare services are provided by independent licensed healthcare professionals.
   DandyRX does not practice medicine and does not provide medical care.

2. Nature of Telehealth Care
   I understand that telehealth differs from traditional in-person medical care.
   I understand that a healthcare provider may not perform a physical examination and may rely on information that I provide through questionnaires, communications, photographs, videos, laboratory results, medical records, and other available information.
   I understand that the quality of care provided through telehealth may be limited by the accuracy and completeness of the information that I provide.

3. Risks of Telehealth
   I understand that potential risks associated with telehealth include:
   • Technical failures;
   • Internet interruptions;
   • Communication delays;
   • Unauthorized access despite security safeguards;
   • Limitations associated with the inability to perform an in-person physical examination;
   • Delays in diagnosis or treatment due to technological limitations.
   I understand that no technology system can guarantee absolute security.

4. Benefits of Telehealth
   I understand that potential benefits of telehealth may include:
   • Improved access to healthcare services;
   • Greater convenience;
   • Reduced travel requirements;
   • Increased continuity of care;
   • Faster access to treatment and follow-up services.
   I understand that benefits cannot be guaranteed.

5. No Guarantee of Treatment or Prescription
   I understand that payment for a consultation, evaluation, membership, subscription, or service does not guarantee that a prescription will be issued.
   I understand that all treatment decisions are made solely by licensed healthcare providers exercising independent professional medical judgment.
   A provider may determine that treatment is not medically appropriate for me.
   A provider may decline to prescribe, renew, continue, or modify any medication.

6. Independent Healthcare Providers
   I understand that healthcare services are provided by independent licensed healthcare professionals.
   DandyRX does not employ healthcare providers to practice medicine on its behalf.
   Healthcare providers are solely responsible for clinical decisions, treatment recommendations, diagnoses, and prescriptions.

7. Pharmacy Services
   I understand that prescriptions, when issued, may be fulfilled by licensed partner pharmacies.
   I understand that pharmacy selection may vary based on provider decisions, patient location, medication availability, and applicable law.
   I understand that DandyRX does not manufacture, dispense, compound, package, or ship prescription medications.

8. Medical Information
   I certify that all information I provide is accurate, truthful, and complete to the best of my knowledge.
   I understand that incomplete, inaccurate, or misleading information may affect the provider’s ability to safely evaluate and treat me.
   I agree to promptly update information that may affect my treatment.

9. Privacy and Confidentiality
   I understand that my medical information may be protected under applicable federal and state privacy laws, including HIPAA where applicable.
   I understand that healthcare providers and DandyRX utilize reasonable safeguards to protect my personal and health information.
   I acknowledge that electronic communications may involve risks despite security measures.

10. Emergency Situations
    I understand that telehealth services are not intended for emergency medical care.
    If I believe I am experiencing a medical emergency, I will immediately call 911 or seek emergency medical treatment.
    I will not rely on DandyRX, its providers, or its messaging systems for emergency care.

11. Right to Withdraw Consent
    I understand that I may withdraw my consent to receive telehealth services at any time by discontinuing use of the Services.
    Withdrawal of consent will not affect actions already taken in reliance upon my consent.
    Withdrawal of consent may affect the availability of future healthcare services.

12. State Law Compliance
    I understand that telehealth services are subject to applicable federal and state laws.
    Certain services, medications, or treatment options may not be available in all jurisdictions.
    Provider availability may vary based on state licensure and applicable regulations.

13. Electronic Consent
    By selecting an acceptance checkbox, clicking “I Agree,” creating an account, submitting a health assessment, scheduling a consultation, participating in telehealth services, or otherwise using the DandyRX platform, I acknowledge and agree that:
    • I have read this Telehealth Informed Consent;
    • I understand the risks and benefits of telehealth services;
    • I have had the opportunity to review this Consent and ask questions;
    • I voluntarily consent to receive healthcare services through telehealth technologies;
    • I understand that no prescription or treatment outcome is guaranteed.
